data processing
The provision of services by the operator makes it necessary for the operator to process the personal data entrusted to him. This is done in compliance with data protection regulations and is limited to the personal data that the operator deems necessary to carry out the services (meaning services in the sense of the General Terms and Conditions).
The legal basis for this data processing is Art. 6 Para. 1 Letter b) GDPR, or upon completion of the registration the consent of the customer and thus Art. 6 Para. 1 Letter a) GDPR).
As part of the registration and the subsequent creation of a profile, the following personal data, among others, are requested:
gender (will be published),
email address (will not be published),
ZIP code (other customers only see the first two digits of the ZIP code),
if applicable district, if not clearly derivable from the postal code (will be published),
the date of birth (is published as age in years).
In addition, the customer answers a series of personal questions that serve as the basis for creating the personal profile. All questions whose answers are not displayed to other customers are always marked.
All information is provided on a voluntary basis. The legal basis for this data processing is Art. 6 Para. 1 Letter b) GDPR, or upon completion of the registration the consent of the customer and thus Art. 6 Para. 1 Letter a) GDPR).
Some of the customer's personal data that the operator considers necessary for a partner search is made accessible to third parties in pseudonymised form via the operator's database.
In particular, the operator may make the following data recorded or derived by the customer available to other customers:
the date of the last login,
Information about the profile status (e.g. logged in, passivated, cannot be reached by email),
the country,
the federal state (or the canton, the department),
the district (if necessary, determined from the postal code),
Date and number of visits to other profiles by the customer (only the profile owner of the profile visited),
the data on the contact with another customer and, if applicable, the read status of communication data (only the other party).
In addition, the operator may forward selected data from the customer profile, which is also visible to other customers via their access, to the e-mail address of other customers (meaning customers within the meaning of the General Terms and Conditions) for the purpose of expanding the group of interested parties.
The legal basis for this data processing is Art. 6 Para. 1 Letter b) GDPR, or upon completion of the registration the consent of the customer and thus Art. 6 Para. 1 Letter a) GDPR).
Basically, the operator treats communication between customers as private. However, the operator reserves the right to access communicated data in the event that third parties notify the operator of a violation of the GTC, or there are indications of this within the framework of a profile check (see also Section 10.f. of the GTC). . The legal basis for this data processing is Art. 6 Para. 1 Letter c) GDPR.
The operator also reserves the right to use automatic filter software in the context of communication between customers to enforce the agreements made with the customer in these General Terms and Conditions (see also Section 5.h. and 5.i. of the General Terms and Conditions). The legal basis for the use of the filter software is Art. 6 Para. 1 Letter f) GDPR: processing is carried out to enforce the agreements made with the customer in these General Terms and Conditions and is therefore necessary to safeguard the legitimate interests of the operator.
The customer is aware of the possibility that third parties could gain knowledge of the transmission of data via an open network such as the Internet at the current state of the art without authorization and is responsible for the transmission security of the data exchanged with the operator's system.
The customer is aware that it is not technically possible to prevent photo material published via the profile from being copied by other customers (e.g. via screenshot).
The operator can move or copy or edit (e.g. rotate, crop, brighten) the photo material published by the customer in the profile (or excerpts thereof) to another profile position as part of the profile review. The legal basis for this data processing is Art. 6 Para. 1 Letter b) GDPR, or upon completion of the registration the consent of the customer and thus Art. 6 Para. 1 Letter a) GDPR).
In addition, the operator reserves the right to initially passivate free memberships of customers who have been inactive for a long time (no visibility of the profile for other customers, contact blocking) and, in the event of continued inactivity, finally also profile parts (e.g. photo material, profile texts), messages (received and sent) and personal ones Delete lists (e.g. visitors, favorites, contacts) if necessary. This passivation or deletion is always announced to the customer (by e-mail) and can be prevented by the customer logging in again. The legal basis for this data processing is Art. 6 Para. 1 Letter b) GDPR, or upon completion of the registration the consent of the customer and thus Art. 6 Para. 1 Letter a) GDPR).
Customers communicate with each other within the operator's website via the internal messaging system.
The internal message system distinguishes between communication via the personal mailbox and the online contact functions "chat" and "text message".
Short messages will be deleted by the operator at the latest at the end of a customer's website session; the operator does not store messages via the chat system at any time.
The personal mailbox is divided into the folders "Incoming Messages", "Outgoing Messages" and "Message Archive".
The operator reserves the right to delete messages in the "Inbox" and "Outbox" folders that are not moved by the customer to the message archive within a certain period of time (will be published on the website in the personal mailbox) without individual notice.
The legal basis for this data processing is Art. 6 Para. 1 Letter b) GDPR, or upon completion of the registration the consent of the customer and thus Art. 6 Para. 1 Letter a) GDPR).
Messages that are automatically sent or received via the personal mailbox as part of website functions (e.g. request for image viewing, photo exchange, etc.) are deleted by the operator without prior notice after they have been processed by the customer.
The legal basis for this data processing is Art. 6 Para. 1 Letter b) GDPR, or upon completion of the registration the consent of the customer and thus Art. 6 Para. 1 Letter a) GDPR).
The customer knows that, among other things, to support the internal message system when visiting the operator's website, the browser automatically requests data from the operator's systems at regular intervals - even if the customer is not active on the website for a long period of time.
